International Election Observer Jide Ojo has suggested that the Supreme Court's decision to uphold Senator Ademola Adeleke's election influenced the Presidential Election Tribunal's ruling to validate President Bola Ahmed Tinubu's victory. He argues that the Supreme Court's stance in the Osun State election revealed that there is no specific timeframe in the law for uploading election results. Additionally, the Supreme Court emphasized the use of BVAS (Biometric Voter Accreditation System) as the only way to address overvoting concerns.
In an interview with AIT news, Ojo explained, "In Senator Ademola Adeleke's case in Osun, the tribunal had a split decision, but the appellate court upheld the minority decision. The initial court had nullified Adeleke's election, primarily due to issues related to about 744 polling units and questions surrounding BVAS and result uploading.
Knowing the impact of the Supreme Court's decision on Adeleke's case, I anticipated it would influence the judgment of the Presidential election petition. The Supreme Court's ruling emphasized the role of BVAS and the weight of evidence necessary to resolve disputes regarding result transmission or delayed uploading. The law does not specify a timeframe for uploading results, and INEC's argument about technical glitches was not considered as a time constraint. Even if uploading began on the second day, the law doesn't impose a specific time frame."
