The Federal High Court sitting in Abuja has voided the election of a member of Kogi Assembly, Atule Egbunu.
The Nation reports that Egbunu, representing Ibaji constituency, was elected on the platform of the All Progressives Congress (APC) in 2020.
Legit.ng gathered that while delivering his judgement on Friday, January 29, Justice Inyang Ekwo, ordered that the candidate of the party that came second in the December 5, 2020, by-election, which produced Egbunu, should be inaugurated in place of the sacked APC candidate.

Justice Ekwo gave the order in the suit marked: FHC/ABJ/CS/173/2020 filed by Joseph Enemona, in which he challenged the propriety of the primary election conducted by his party, the APC, to chose a candidate for the by-election.
The Independent National Electoral Commission (INEC) had declared APCs Egbunu winner with 8,515 votes, while PDPs candidate for the election, Daniel Enefola came second with 4,564 votes in the December 5, 2020 election.
Justice Ekwo, in the judgment, upheld the plaintiffs claim that the APC did not conduct a valid primary election.
He noted that while seven aspirants were to participate in the primary election, the party unlawfully manoeuvred the process, made the participation of a single aspirant possible and denied the other six the opportunity to participate.
He added that the APC acted unlawfully by conducting the purported primary election outside the partys secretariat, as required by law.
The judge held that the time for the conduct of primary and nomination of a candidate for the December 5, 2020 bye-election had lapsed.

Meanwhile, Legit.ng had previously reported that the key loyalists of former governor of Ogun state, Ibikunle Amosun, at the state House of Assembly defected to the All Progressives Congress (APC).
It was reported that the seven lawmakers, who were loyalists of Amosun, the senator representing Ogun Central, dumped the Allied Peoples Movement (APM) and returned to the APC on Thursday, January 28.
When the schools were closed in March due to the corona virus pandemic, teachers and learner's were all ordered to stay at home untill further notice in a way to curb the spread of the virus in the country.
Several months later, the government changed the tune of staying at home, and introduced a program, the Community Based Learning, that would see teachers engage learners at the village level.
The idea of the community based learning brought a lot of confusion amongst teachers, parents and the learners since the facts behind its approval were not clear. The education CS, professor Magoha insisted that the program was to start, with each teacher engaging a maximum of 15 learners for a period if 5 hours.
However, the program was in itself confusing and to some extent illogical not only to the learners but also to the teachers. The fact that it was supposed to take place at the community level, it would be hard to get venues to accommodate the over 15 million learners.
Social amenities like toilets, water, soap amongst others were not considered when the program was put in place. Instead the government was giving orders for the program to start, yet the amenities are extremely important, not only for Covid-19 protection matters but also for other hygiene reasons.
The total number of the learners could have overwhelmed the 300,000 teachers population. For the program to be executed flawlessly and without hitches ensuring all learners catered for, the over 15 million learners in groups of 15 each would need at least 1million teachers. This would therefore mean that the programme would benefit only a small fraction of the learners, while the others would lack venues and teachers.
The infrastructure to be used when executing the programme should have been considered. The curriculum and the content, materials like books and writing materials were all needed to ensure the program is productive. Teachers were also supposed to be taken through an induction workshop to ensure that they deliver the required content. Instead, the tutors were being bulldozed to avail themselves and start the programme, right from home.
The government should have considered the safety of the learners and the teachers while in the community undertaking the learning. Instead, the education CS, Hon. Magoha affirmed that the teachers needed no protective equipments (PPE's) to pretect the programme. This showed that the government did not see a possibility of the virus finding it's way into the programme, since the teachers and the learners did not need the protective gears.
The places where the learning would have taken place were also supposed to be attended to on daily basis by the ministry of health, with fumigation being a daily practice to ensure the learners and the teachers are safe from the virus. Other protective materials like sanitizers and masks were all needed.
Before the learners and the teachers could be cleared to attend the community based learning lessons, it was important to test them, so that the whole program could not seem like a gamble. This means that the government should have done over 16 million tests to the teachers and learners, so as to ensure that the learners and teachers are safe and ready for each other.
Instead, all these important facts were somehow ignored, with the call to attend the programme being the main line of instructions to the teachers. The government was therefore ill advised on the program because it would have been better if they put their emphasis on laying the preparations for the reopening of schools.
At the moment, the programme have been shelved for some time pending the hearing of a court case involving the reopening of schools. The Teachers Service Commission on it's side ordered all teachers not to participate in the programme untill further notice.
The government have also boosted the hopes to learners and teachers that the schools may resume sooner than expected since the Covid-19 curve was reportedly flattening.
I know that many of you are angry, and understandably so. We couldve moved faster and for this we are sorry.
I fully understand how many young people feel. Many feel that we have been too silent and have simply not done enough.
These feelings of frustration are justified.
There are far too many people who have been brutalised at the hands of the police and this is unacceptable. We must take responsibility for protecting young people, even sometimes from those who are paid to protect them.
Over the past week, we have been following the protests, and I have had a number of discussions with key people in the administration that you deserve to be informed about. Transparency, after all, is a key tenet of government.
Several meetings have been held with: the Senate President Ahmad Ibrahim Lawan, Speaker of the House Representatives, Femi Gbajabiamila, the Chief of Staff to President Muhammadu Buhari, Chairman of the Police Service Commission, the IG of the Nigerian Police (IGP), the Executive Secretary of National Human Rights Commision Nigeria, and governors.
We understand that you want to see action from us and Im here to tell you that work is ongoing. I chaired a meeting of 36 state governors and the Minister of the FCT (NEC), where we resolved to set up judicial panels of inquiry so we can see justice served, and fast.
The reason being that only state governors, by law, can set up judicial inquiries in their states. The hearings will be public.
With Mr. Presidents approval, SARS has been completely disestablished, and none of its former members will feature in any police tactical units.
I am sending my deepest condolences to the families of Jimoh Isiaq, and all those who have lost their lives at the hands of wayward police officers. To those injured, I wish a full and speedy recovery.
We have proposed that each state government sets up a Victims Support Fund, which the Nigerian Government will support. This is the least that we can do to compensate for the injustice suffered at the hands of errant officers.
We also understand that the issues that youre raising are bigger than just SARS. Theyre deep and systemic and were undertaking comprehensive measures that will revamp the police by addressing issues of welfare, service conditions and training.
On Monday, Mr. President also reiterated his commitment to these extensive police reforms.
We will continue to update and engage with you all on these action steps and the ones to come, in the spirit of transparency, so that you can hold us accountable. We are, after all, here to serve you and we owe you a duty to win back your trust.
